1. Acceptance of Terms & Legal Parties
These Terms of Service constitute a legally binding agreement between you ("Guest", "User", or "Client") and Encore Wonderstack Hospitality AG (CHE-482.910.374), Gotthardstrasse 26, 8002 Zürich, Switzerland. By accessing encorewonderstack.com or executing a reservation for any Swiss alpine sanctuary or wellness facility, you expressly agree to these terms.
2. Reservation Protocols, Deposits & Cancellations
All chalet reservations require verification of primary guest identity and receipt of a minimum 30% non-refundable architectural reservation deposit at the time of booking. The remaining balance must be settled no later than 45 days prior to arrival.
- Standard Cancellation: Cancellations received more than 60 days before scheduled arrival are eligible for a 70% refund of total fees paid.
- Force Majeure & Weather Conditions: Due to extreme high-altitude alpine conditions (avalanches, helicopter groundings, alpine passes closure), Encore Wonderstack reserves the right to arrange alternative lodging within the same elevation class or issue equivalent stay credits.
3. Property Care & Alpine Safety Obligations
Guests agree to maintain the structural integrity, custom furnishings, and hydrothermal installations of the rented chalet. High-altitude environments present inherent geographic hazards; guests must comply with all posted snow safety indicators, sauna operation guidelines, and local mountain guide instructions.
4. Intellectual Property Rights
All architectural blueprints, 3D spatial models, graphic interfaces, photography, and text appearing on encorewonderstack.com are the exclusive intellectual property of Encore Wonderstack Hospitality AG and protected under Swiss Federal Copyright Law (*Urheberrechtsgesetz*).
5. Limitation of Liability
To the maximum extent permissible under the Swiss Code of Obligations (*OR Article 100*), Encore Wonderstack Hospitality AG disclaims liability for indirect, incidental, or consequential damages resulting from off-piste skiing activities, severe weather disruptions, or personal belongings left unattended in chalet premises.
6. Governing Law & Jurisdiction
These Terms shall be construed and governed strictly in accordance with the substantive laws of Switzerland, excluding its conflict of laws principles. The exclusive place of jurisdiction for all disputes arising from or in connection with these terms is the commercial courts of Zürich, Canton of Zürich, Switzerland.
